What is an Intellectual Property Agreement?

Consider using an Intellectual Property Agreement when you, as an employer or employee, want to outline the ownership, transfer, and rights associated with a particular intellectual property. More often, it is the employer who receives the full ownership of the intellectual property created during an employee’s employment period, unless both parties phrase it differently. 

An Intellectual Property Agreement can be an entire document on its own, or you can include it as a clause within an agreement. If it is the latter, the employer should disclose this critical clause. The employee should also ensure they read their employment contract in detail to ensure they understand the extent of their rights they are relinquishing.

In addition to the copyright ownership an employee is giving up, the agreement can also state that they are also giving up their moral rights. This means that they are surrendering the right to be named as the originator of the work and to determine how the new owner will use it.
